Article 15 – Right to rectification

Commission Proposal

1. Member States shall provide for the right of the data subject to obtain from the controller the rectification of personal data relating to them which are inaccurate. The data subject shall have the right to obtain completion of incomplete personal data, in particular by way of a corrective statement.2. Member States shall provide that the controller informs the data subject in writing on any refusal of rectification, on the reasons for the refusal and on the possibilities of lodging a complaint to the supervisory authority and seeking a judicial remedy.

EDRi’s proposed amendment

1. Member States shall provide for the right of the data subject to obtain from the controller the rectification of personal data relating to them which are inaccurate. The data subject shall have the right to obtain completion of incomplete personal data, in particular by way of a corrective statement. The controller shall not be able to refuse the rectification request if the personal data contained therein are factually correct.2. Member States shall provide that the controller informs the data subject in writing on any refusal of rectification, on the reasons for the refusal and on the possibilities of lodging a complaint to the supervisory authority and seeking a judicial remedy.
